Agreement to Terms

By accessing or using the Service you confirm that you have read, understood, and agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and “you” refers to that organization. If you do not agree to these Terms, do not use the Service.

Description of the Service

OSINT Elite provides tools for open-source intelligence (OSINT) research. The Service lets you submit an identifier — such as a username, email address, phone number, name, domain, or other public selector — and returns information aggregated and consolidated by OSINT Elite into a single result or report.

Demo and evaluation features are provided for illustration purposes. They may apply rate limits, shared quotas, caching, and other restrictions, and may be modified, suspended, or withdrawn at any time without notice.

Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction if higher, and legally able to enter into a binding contract. The Service is intended for professional, investigative, compliance, security, journalistic, and research use by competent persons and organizations. We may, at our discretion, require identity verification or other vetting (including know-your-customer information) as a condition of access, and may decline or revoke access at any time.

Lawful and Acceptable Use

You are solely responsible for ensuring that your use of the Service, and of any information obtained through it, is lawful in every jurisdiction that applies to you and to the data subject. You agree to use the Service only for legitimate purposes and in compliance with all applicable laws, including data-protection and privacy laws such as the GDPR and equivalent regimes.

You must not use the Service to:

• stalk, harass, threaten, defraud, dox, blackmail, or endanger any person;
• make decisions about credit, insurance, employment, housing, or other eligibility in a manner regulated by consumer-reporting or anti-discrimination laws;
• process information about a person without a lawful basis where one is required, or in violation of that person’s rights;
• infringe intellectual-property rights, breach confidentiality obligations, or circumvent access controls;
• resell, sublicense, scrape, or systematically extract the Service or its outputs except as expressly permitted in writing; or
• attempt to disrupt, overload, reverse-engineer, or gain unauthorized access to the Service or its infrastructure.

Accounts, API Keys, and Access

Some features require an account or an API key. You are responsible for keeping your credentials confidential and for all activity that occurs under them. You agree to notify us promptly of any unauthorized use. We may suspend or rotate credentials where we reasonably believe they have been compromised or misused.

Where access is provided on a subscription or quota basis, access rights are non-exclusive, non-transferable, and limited to the agreed term and volume. Unused quota does not roll over and is not refundable except as required by law or as expressly agreed in writing.

Data Sources and Accuracy

Information returned by the Service is aggregated from a variety of public, commercial, and licensed data sources and is provided on an “as available” basis. Such information may be incomplete, outdated, inaccurate, ambiguous, or attributable to the wrong person, and availability of any particular result is not guaranteed.

You must independently verify any result before relying on it, and you must not treat the Service’s output as a consumer report or as conclusive proof of any fact. OSINT Elite does not warrant the accuracy, completeness, legality, or fitness of any result for your intended purpose.

Intellectual Property

The Service, including its software, interfaces, documentation, design, and trademarks, is owned by OSINT Elite or its licensors and is protected by intellectual-property laws. Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Service for your internal purposes. No other rights are granted.

Privacy and Data Protection

Our handling of personal data in connection with operating the Service is described in our Privacy Policy. Where you submit identifiers or other personal data to the Service, you represent that you are entitled to do so and that doing so does not violate any person’s rights or any applicable law. As between the parties, you act as controller for the personal data you choose to process through the Service, and OSINT Elite acts as a processor or independent controller as the context requires.

Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or that any result will be available or correct.

Limitation of Liability

To the fullest extent permitted by law, OSINT Elite and its affiliates, officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business, arising out of or relating to your use of (or inability to use) the Service, even if advised of the possibility of such damages. Our aggregate liability for any claim relating to the Service will not exceed the greater of the amounts you paid to us for the Service in the three months preceding the event giving rise to the claim, or one hundred euros (€100). Nothing in these Terms excludes liability that cannot be excluded under applicable law.

Indemnification

You agree to indemnify and hold harmless OSINT Elite and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any law or the rights of any third party — including any unlawful or improper handling of information obtained through the Service.

Suspension and Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have breached these Terms, created risk or legal exposure for us, or used the Service unlawfully. You may stop using the Service at any time. Provisions that by their nature should survive termination — including those on acceptable use, disclaimers, liability, indemnification, and governing law — will survive.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service.

Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them or their subject matter are governed by, and construed in accordance with, the laws of England and Wales, without regard to conflict-of-laws principles. The courts of England and Wales will have exclusive jurisdiction, except that we may seek injunctive relief in any competent court. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
